Councils distinguish between an annexe that stays part of the main household, used by a family member with shared arrangements, and a separate self contained dwelling that could be sold or let independently. How the annexe connects to the house, whether it has its own access and how independent the facilities are all feed into which side of that line the council places it. Be honest about intended use from the outset, because conditions are often attached limiting occupation to a family member.

Building regulations, which now apply properly

A building with sleeping accommodation must meet the building regulations. In practice that touches nearly every part of the build.

• Structure and foundations designed and inspected
• Thermal performance for walls, floor, roof and glazing
• Fire safety, including escape provision and alarm interlinking
• Ventilation and moisture control
• Drainage for kitchen and bathroom waste
• Electrical installation certified, and often a wired heat and smoke detection system

Drainage is the practical hurdle

A kitchen and bathroom mean foul drainage, and gardens are not always cooperative. If the existing drainage run sits at the wrong level or on the wrong side of the house, you may need a pumped system, and that has its own maintenance and power requirements.

Find the drains and their levels early. It regularly influences where in the garden the annexe should sit, which in turn affects the planning drawings.

Heating, comfort and living with it daily

An annexe is occupied around the clock, not for a working day, so comfort standards need to be higher than a garden office. Insulation, controllable heating, hot water and good ventilation all matter more when someone is showering and cooking in there every day.

For an older relative, add level access, wider doorways, a level access shower and good lighting at the design stage rather than adapting later.

Council tax and the paperwork side

A self contained annexe can be assessed separately for council tax, though there are reliefs and discounts in some circumstances such as occupation by a dependent relative. Rules and reliefs change, so check the current position with your local authority and, where relevant, take advice before you commit.

It is also worth telling your buildings insurer, since a habitable garden building is not the same risk as a shed.

How the build differs from a garden room

Longer programme, deeper foundations, drainage works, building control inspections at stages, and a full internal fit out with kitchen and bathroom. Budget accordingly rather than starting from a garden room price and adding a bit.
